MORTGAGE FORECLOSURE NOTICE
Default having been made in the terms of that Mortgage executed on the 10th day of November, 2006, by Roger Chambers and Amanda M. Chambers to Small Town Bank, which said mortgage is recorded in the Office of the Judge of Probate, Randolph County, Alabama in Mortgage Book 506 at Page 709; and default continuing, and by virtue of the power of sale contained in said mortgage, the following described property will be sold at public outcry, for cash, to the highest bidder, in front of the front Courthouse door of the Randolph County Courthouse in Wedowee, Alabama, at 11 o’clock a.m. on the 21st day of July, 2023.
Lot #3 of Riv-A-Run Subdivision according to the plat and survey of Re-Subdivision of Riv-A-Run Subdivision as recorded in Plat Book 4, Page 56, in the Office of the Judge of Probate of Randolph County, Alabama.
Subject to Restrictive Covenants as set forth in Deed Book 156 at Pages 215 through 220 in the Office of the Judge of Probate of Randolph County, Alabama.
Subject to all easements and rights owned by the Alabama Power Company to that portion lying between the 795’ and 800’ mean sea level elevation.
Subject to that certain perpetual easement executed by S. Leon and Myrte Foster to Alabama Power Company recorded September 24, 1980 in Deed Book 127 at Page 27 as found in the office of the Judge of Probate of Randolph County, Alabama.
Subject to that certain agreement between Charles Foster and Hershall and Minnie Collins recorded October 6, 1988 in Deed Book 152 at Page 45 as found in the office of the Judge of Probate of Randolph County, Alabama.
Subject to the Final Subdivision Report of Alabama Department of Health as to Riv-A-Run Subdivision recorded March 6, 1992 in Deed Book 184 at Page 123 as found in the office of the Judge of Probate of Randolph County, Alabama.
Property will be sold “as is” with any and all liens or encumbrances of record. Said sale is made for the purpose of paying the mortgage debts and cost of foreclosure, and will be conducted by Chad Lee. Payment in full is due at the time of sale.
