MORTGAGE FORECLOSURE SALE

Default having been made in the payment of the indebtedness secured by that certain mortgage executed by Lance C. Dennis and Karen D. Dennis, originally in favor of Wells Fargo Bank, N.A., on the 30th day of September, 2010, said mortgage recorded in the Office of the Judge of Probate of Randolph County, Alabama, in Mort Book 558, Page 255; the undersigned Wells Fargo Bank, N.A., as Mortgagee/Transferee, under and by virtue of the power of sale contained in said mortgage, will sell at public outcry to the highest bidder for cash, in front of the main entrance of the Courthouse at Wedowee, Randolph County, Alabama, on May 18, 2015, during the legal hours of sale, all of its right, title, and interest in and to the following described real estate, situated in Randolph County, Alabama, to-wit:

All that tract or parcel of land lying and being in the Northeast Quarter of the Northeast Quarter of Section 28, Township 19 South, Range 10 East, Randolph County, Alabama, being more particularly described as follows: Commencing at a nail found in a Rockpile at the Northwest corner of the Northeast Quarter of the Northeast Quarter of Section 28, Township 19 South, Range 10, East, Randolph County, Alabama; thence South 57 degrees 01 minutes 15 seconds East for a distance of 742.19 feet to an iron pin; thence run South 13 degrees 32 minutes 29 seconds West for a distance of 102.86 feet, more or less, to an iron pin and the true point of beginning of the hereafter described parcel of land; thence due East for a distance of 212.38 feet, more or less, to an iron pin; thence due South for a distance of 12.55 feet, more or less, to a point on the 795-foot contour and property line of the R L. Harris Reservoir; thence South 86 degrees 19 degrees 12 minutes West along the 795- foot contour and property line for a distance of 24.73 feet, more or less, to a point; thence South 08 degrees 50 minutes 24 seconds West along the 795-foot contour and property line at the R. L. Harris Reservoir for a distance of 19.51 feet, more or less, to a point; thence run South 04 degrees 09 minutes 16 seconds West, along the 795-foot contour and property line of the RL. Harris Reservoir for a distance of 15.32 feet, more or less, to a point; thence run South 00 degrees 20 minutes 21 seconds West along the 795-foot contour and property line of the R.L. Harris Reservoir for a distance of 17.41 feet, more or less, to a point; thence run South 49 degrees 59 minutes 29 seconds East along the 795-foot contour and property line of the RL. Harris Reservoir for a distance of 27.53 feet, more or less, to a point; thence leaving the 795-foot contour and property line of the R.L. Harris Reservoir and run South 33 degrees 03 minutes 22 seconds West for a distance of 182.79 feet, more or less, to a point on the North right-of-way of Randolph County Road No. 2811 (said road leaving a 40-foot right-of-way); thence run South 87 degrees 33 minutes 11 seconds West along the North right-of-way line of Randolph County Road NO. 2811 for a distance of 41.60 feet, more or less, to a point on the East side of a 40-foot ingress-egress and utility easement; thence run in a northwesterly direction along the arc of a curve an arc distance of 50.32 feet to an iron pin (said curve having a radius of 90.00 feet and being subtended by a chord bearing North 17 degrees 04 minutes 15 seconds West, a chord distance of 49.67 feet); thence continue along the east side of a 40-foot ingress-eqress utility easement and run North 34 degrees 23 minutes 00 seconds West for a distance of 70.00 feet, more or less, to a point; thence run in a northerly direction along the arc of a curve an arc distance of 131.34 feet to an iron pin (said curve having a radius of 165.00 feet and being subtended by a chord bearing North 04 degrees 13 minutes 47 seconds West, a chord distance of 127.90 feet), said pin being the true point of beginning.

The above described property contains 0.809 acres, more or less, and is the same property as shown on a survey dated August 13, 2003, for Johnny Abbott, prepared by J.R Harrison, Alabama RLS No. 1509 (property designated as Tract 1 on said survey) and is incorporated herein by reference.

This property is subject to all ownership, interests and easements owned by the Alabama Power Company to that portion of the property that lies below the 800-foot mean sea level elevation, Huntsville Meridian.

Also conveyed herein a 40 foot wide easement for ingress and egress and utilities from Randolph County Road No. 2811, which lies immediately West of a line described as follows: Commencing at a nail found in a Rockpile at the Northwest corner of the Northeast Quarter of the Northeast Quarter of Section 28, Township 19 South, Range 10 East; thence South 57 degrees 01 minutes 15 seconds East for a distance of 742.19 feet to an iron pin and the point of beginning of the East line of said 40 foot wide easement; thence run South 13 degrees 32 minutes 29 seconds West for a distance of 102.86 feet to a point; thence run an arc distance 131.34 feet (chord of said arc being South 04 degrees 13 minutes 47 seconds East for distance 127.90 feet); thence run South 34 degrees 23 minutes 00 seconds East for a distance of 70.00 feet to a point; thence run an arc distance of 50.32 feet (chord of said arc being South 17 degrees 04 minutes 15 seconds East for a distance of 49.67 feet) to a point on the northerly right of way Randolph County Road No. 2811 (having a 40 foot right of way), said point being the point of beginning of the East line of said 40 foot wide easement.

THIS PROPERTY WILL BE SOLD ON AN “AS IS, WHERE IS” BASIS, SUBJECT TO ANY EASEMENTS, ENCUMBRANCES, AND EXCEPTIONS REFLECTED IN THE MORTGAGE AND THOSE CONTAINED IN THE RECORDS OF THE OFFICE OF THE JUDGE OF PROBATE OF THE COUNTY WHERE THE ABOVE-DESCRIBED PROPERTY IS SITUATED. THIS PROPERTY WILL BE SOLD WITHOUT WARRANTY OR RECOURSE, EXPRESSED OR IMPLIED AS TO TITLE, USE AND/OR ENJOYMENT AND WILL BE SOLD SUBJECT TO THE RIGHT OF REDEMPTION OF ALL PARTIES ENTITLED THERETO.

This sale is made for the purpose of paying the indebtedness secured by said mortgage, as well as the expenses of foreclosure.

The Mortgagee/Transferee reserves the right to bid for and purchase the real estate and to credit its purchase price against the expenses of sale and the indebtedness secured by the real estate.
