MORTGAGE FORECLOSURE NOTICE

Default having been made in the terms of that Mortgage executed on the 8th day of August, 2006 by Michael O’Brien Smith, a single person to Small Town Bank-Main Office, which said mortgage is recorded in the Office of the Judge of Probate, Randolph County, Alabama, in Mortgage Book 501 at Pages 362-368, and default continuing, and by virtue of the power of sale contained in said mortgage, the following described property will be sold at public outcry, for cash, to the highest bidder, in front of the Courthouse door of said County, in Wedowee, Alabama, at 11 o’clock a.m. on the 6th day of March, 2015:

Tract or parcel Number 8 of Woodland Acres Subdivision according to the survey map of Walter Pryor White, AL. Reg. No. 12504 as recorded in the Office of the Judge of Probate of Randolph County, Alabama, in Plat Book 3, at Page 67.

Subject to the rights-of-way and easements as previously conveyed to the Alabama Power Company and a Right-of-Way easement from paved road along existing graveled road to the above-mentioned tract or parcel.

Subject to rights-of-way previously conveyed to Randolph County recorded in Deed Book 49, at Page 105; Office of the Judge of Probate of Randolph County, Alabama.

Subject to Pole Line Permits previously conveyed to the Alabama Power Company recorded in Deed Book 49, at Page 250 and Deed Book 53, Page 77; Office of the Judge of Probate of Randolph County, Alabama.

Property will be sold “as is” with any and all liens or encumbrances of record. Said sale is made for the purpose of paying the mortgage debts and cost of foreclosure, and will be conducted by Chad Lee. Payment in full is due at the time of sale.
