NOTICE OF MORTGAGE FORECLOSURE SALE
Default having been made in the payment of indebtedness secured by that certain mortgage executed by B. O. Loftin, a married man, and Richard Thomas Loftin, a married man, on the 16th day of February, 2006 to Bank of Wedowee which said mortgage is recorded in the Probate Office of Randolph County, Alabama, in Mortgage Book 493, at Page 483, and by reason of such default, having declared all of the indebtedness secured by said mortgage due and payable, and such default continuing, notice is hereby given that, acting under the power of sale contained in said mortgage, Bank of Wedowee will sell at public outcry, for cash, to the highest bidder, before the west entrance of the Courthouse in the City of Wedowee, Randolph County, Alabama, at 12:00 noon or otherwise during the legal hours of sale on February 3, 2015 the following described real estate situated in Randolph County, Alabama, to-wit:
Property located in the Wedowee Industrial Park in Section 4, Township 20 South, Range 11 East, in Randolph County, Alabama, being more particularly described as follows: Commencing at the intersection of the North R.O.W. of Alabama Highway 48 and the West R.O.W. of School Street in Wedowee, Alabama, said point being the SE corner of the Wedowee Industrial Park and the point of beginning: thence South 86 degrees 30 feet West along the North R.O.W. of Alabama Highway 48 a distance of 238 feet to a point on the North R.O.W. of said Highway; thence North 32 degrees 00 feet West along a ditch (upgrade) a distance of 890 feet to a point on the South side of a road in the Wedowee Industrial Park; thence North 75 degrees 00 feet East along the South side of said road a distance of 315.2 feet to a point; thence run along the South side of a proposed Park road and a curve to the right a distance of 175 feet to a point; thence continue along the South side of proposed Park road South 68 degrees 54 feet East a distance of 334.5 feet to a point on the South side of proposed Park road and the West R.O.W. of School Street; thence along the West R.O.W. of School Street in a Southerly direction a distance of 733 feet to the point of beginning. Less and except the easement for public and municipal utilities.
Together with the hereditaments and appurtenances thereunto belonging and all fixtures now attached to and used in connection with the premises herein described.
Said sale will be subject to the right of way easements and restrictions of record in the Probate Office of Randolph County, Alabama, and will be subject to existing special assessments, if any, which might adversely affect the title to subject property.
Said property will be sold on an “As Is, Where Is” basis without warranty or recourse, express or implied as to title, use and/or enjoyment.
Said sale will be made for the purpose of paying the indebtedness secured by the above described mortgage, and the proceeds thereof will be applied as provided by the terms of said mortgage. The Mortgagee reserves the right to bid for and purchase the real estate and to credit its purchase price against the expenses of sale and the indebtedness secured by the real estate.
The failure of any high bidder to pay the purchase price and close this sale shall, at the option of Mortgagee, be cause for rejection of the bid, and if the bid is rejected, Mortgagee shall have the option of making the sale to the next highest bidder who is able, capable and willing to comply with the terms thereof.
This sale is subject to postponement or cancellation.
