MORTGAGE FORECLOSURE SALE
Default having been made in the payment of the indebtedness secured by those certain Mortgages executed by ALLEN Y. YIELDING, Married, Not Homestead Property, to SMALL TOWN BANK on August 18, 2006, said Mortgage being recorded in Book 501, Page 782, Mortgage executed on September 4, 2008 and recorded in Book 536, Page 145 and Mortgage executed on April 21, 2009 and recorded in Book 548, Page 800 in the Office of the Judge of Probate, Randolph County, Alabama; and SMALL TOWN BANK, Mortgagee, by reason of such default having declared all of the indebtedness secured by said Mortgages due and payable and by virtue of the power of sale contained in said Mortgages will sell at public outcry for cash to the highest bidder, in front of the main entrance of the Randolph County Courthouse, Wedowee, Alabama, during the legal hours of sale on October 4, 2011, the following described real estate:
Lots 1 & 2 of Lessie’s Landing recorded in Plat Cabinet B at Slide 439 as found in the Office of the Judge of Probate of Randolph County, Alabama.
Subject to the Restrictive Covenants of the Lessie’s Landing recorded in Deed Book 307 at Page 117, as found in the Office of the Judge of Probate of Randolph County, Alabama.
Subject to that certain perpetual easement executed by Bert and Lessie Mitchell to Alabama Power Company dated October 8, 1980 and recorded October 9, 1980 in Deed Book 127 Pages 240-242 as found in the Office of the Judge of Probate of Randolph County, Alabama.
Less and except all rights and easements owned by Alabama Power Company lying below the 800 foot mean sea level elevation as set by the U.S. Geological Survey.
This sale is made for the purpose of paying the indebtedness secured by the above-described Mortgages, and the proceeds thereof will be applied as provided by the terms of said Mortgages.
