Default having been made in the payment of the indebtedness secured by that certain mortgage executed by Christopher C. Siggers, an unmarried man, to First Citizens Bank, on the 8th day of March, 2001, said mortgage recorded in the Office of the Judge of Probate of Randolph County, Alabama, in Mortgage Book 410, Page 767; the undersigned RBC Bank (USA) successor by merger with First American Bank, successor by merger with First Citizens Bank, as Mortgagee/Transferee, under and by virtue of the power of sale contained in said mortgage, will sell at public outcry to the highest bidder for cash, in front of the main entrance of the Courthouse at Wedowee, Randolph County, Alabama, on June 1, 2011, during the legal hours of sale, all of its right, title, and interest in and to the following described real estate, situated in Randolph County, Alabama, to-wit:

Commence at the Northwest corner of the Southeast quarter of the Southeast quarter of Section 6, Township 21 South, Range 10 East, Randolph County, Alabama; thence South 87 degrees 49 minutes 25 seconds West, a distance of 156.04 feet to a point in the center of an abandoned county Road; thence along centerline South 12 degrees 56 minutes 40 seconds East, a distance of 99.35 feet; thence continue South 6 degrees 08 minutes 04 seconds East, a distance of 115.15 feet to the Point of Beginning; thence leaving centerline go South 89 degrees 52 minutes 59 seconds East, a distance of 623.96 feet; thence South 7 degrees 21 minutes 07 seconds West, a distance of 630.00 feet; thence North 88 degrees 53 minutes 30 seconds West, a distance of 210.00 feet; thence South 7 degrees 21 minutes 07 Seconds West, a distance of 210.00 feet; thence North 88 degrees 53 minutes 30 seconds West, a distance of 420.00 feet to a point on the East right of way of County Road No.5; thence North 0 degree 50 minutes 51 seconds East along said right of way, a distance of 331.01 feet to its intersection with the centerline of said Abandoned County Road; thence along said centerline the following courses:  North 18 degrees 06 minutes 19 seconds East, a distance of 296.84 feet; thence North 6 degrees 27 minutes 33 seconds East, a distance of 152.69 feet; thence North 0 degree 54 minutes 27 seconds West, a distance of 57.34 feet to the Point of Beginning.

THIS PROPERTY WILL BE SOLD ON AN “AS IS, WHERE IS” BASIS, SUBJECT TO ANY EASEMENTS, ENCUMBRANCES, AND EXCEPTIONS REFLECTED IN THE MORTGAGE AND THOSE CONTAINED IN THE RECORDS OF THE OFFICE OF THE JUDGE OF PROBATE OF THE COUNTY WHERE THE ABOVE-DESCRIBED PROPERTY IS SITUATED.  THIS PROPERTY WILL BE SOLD WITHOUT WARRANTY OR RECOURSE, EXPRESSED OR IMPLIED AS TO TITLE, USE AND/OR ENJOYMENT AND WILL BE SOLD SUBJECT TO THE RIGHT OF REDEMPTION OF ALL PARTIES ENTITLED THERETO.
