NOTICE OF MORTGAGE FORECLOSURE SALE

Default having been made in the payment of indebtedness secured by

that certain mortgage executed by Larry E. Cohen, an unmarried man, on the

15th day of March 2002, to Bank of Wedowee which said mortgage is recorded

in the Probate Office of Randolph County, Alabama, in Mortgage Book 426, at

Page 507, and by reason of such default, having declared all of the

indebtedness secured by said mortgage due and payable, and such default

continuing, notice is hereby given that, acting under the power of sale

contained in said mortgage, Bank of Wedowee will sell at public outcry, for

cash, to the highest bidder, in front of the Courthouse door, west entrance

in the City of Wedowee, Randolph County, Alabama, at 2:00 o’clock P.M. or

otherwise during the legal hours of sale on January 6, 2010 the following

described real estate situated in Randolph County, Alabama, to-wit:

Lots 6 and 7, Rose Hill Subdivision, as shown on a map recorded in Plat Book

2, Page 4, in the Office of the Judge of Probate of Randolph County, Alabama

and made in accordance with the requirements of the minimum technical

standards for the practice of land surveying in the State of Alabama and

being more particularly described as follows: Commencing at the

intersection of the Southerly right-of-way line of Bullock Street with the

Westerly right-of-way line of Woodland Avenue, said point being the true

point of beginning of the parcel of land herein described; thence South 02

degrees 39 minutes 55 seconds East along last mentioned right-of-way line

113.00 feet; thence leaving said right-of-way line South 87 degrees 55

minutes 38 seconds West 129.13 feet; thence North 08 degrees 32 minutes 57

seconds West 112.02 feet to the Southerly right-of-way line of said Bullock

Street; thence North 87 degrees 14 minutes 21 seconds East along said

right-of-way line 140.60 feet to the true point of beginning. Said parcel

of land lying in Section 35, Township 21 South, Range 12 East in Randolph

County, Alabama, and containing 0.347 acres.

ALSO:

Starting at the intersection of the East right-of-way of North Main Street

and the North right-of-way of the Seaboard Coastline Railroad; thence

Northwesterly along Main Street 90.45 feet to the point of beginning; thence

continue along Main Street North 24 degrees 26 minutes 13 seconds West 73.74

feet; thence North 75 degrees 59 minutes 44 seconds East 454.01 feet; thence

South 66 degrees 43 minutes 41 seconds West 146.69 feet; thence South 66

degrees 33 minutes 52 seconds West 188.42 feet; thence South 66 degrees 41

minutes 32 seconds West 111.48 feet to the point of beginning. Said parcel

containing 0.3774 acres according to that survey done by William L. Morkes

dated April 1, 1996.

ALSO:

One dwelling house and lot in the City of Roanoke, Alabama. Said house and

lot described within the following boundary: Beginning on the North side of

Government Street; thence in a Northerly direction along a wire fence, which

is the East boundary of property in the possession of the North Alabama

Methodist Conference, and continuing along property in the possession of Mr.

and Mrs. H.P. Awbrey and Mrs. J.F. Gittings; thence in an Easterly direction

along the meanderings of a fence, which is the West boundary of property in

the possession of Edgar Stevenson, and thence continuing in a Southerly

direction along the West boundary of a house and lot in the possession of

Mrs. Townley, and continuing on in a Southerly direction to the North

boundary of the said Government Street; thence along the North boundary of

said Government Street a distance of 115 feet to the beginning point. Said

house and lot being further described as a house and lot in a deed that

appears of record in Deed Record Book 34, Pages 363-364 in the Office of the

Judge of Probate of Randolph County, Alabama.

ALSO:

One house and lot located on White Street in the City of Roanoke, Alabama,

described as follows: Begin at the SE corner of the J. Henderson lot on the

North side of White Street, thence run East along North side of said street

a distance of 45 feet to a corner, which corner is the SW corner of a lot,

now owned by Eula Mae Seegar Harrison; thence run North a distance of 410

feet to a corner; thence run West 20 feet to a corner, which is a corner of

said J. Henderson lot; thence South along the said Henderson lot a distance

of 410 feet to the beginning point on said White Street.

One house and lot located on White Street in the City of Roanoke, Alabama,

described as follows: Beginning on the North side of White Street at the SW

corner of the T.M. Payne lot, formerly owned by W.F. Ussery, thence running

West on said White Street a distance of 60 feet to a corner; thence running

in a Northern direction at a distance of 270 feet, more or less, to an iron

pipe corner, which corner is on the West line of said R.M. Payne lot; thence

South along the said T.M. Payne lot to the beginning point on said White

Street.

ALSO:

That certain lot or tract of land in the City of Roanoke, Alabama, in that

part known as the Hornsby-McCarter subdivision in Block “C”, particularly

described and bounded as follows: Begin at a point which is the Southwest

corner of residence lot known as the R.L. Brumbeloe home and the Northwest

corner of residence lot known as the W.A. Pool home, and run Westerly along

common property line between the lot or tract here described and property of

G.O. Myhand, a distance of one hundred eight-eight (188) feet, more or less,

to the Easterly margin of Price Street, run thence Southerly along the

Easterly margin of said Price Street, a distance of one hundred and seven

(107) feet to a corner at the property line of residence of lot of George

Tom Stephens, run thence Easterly along common property line between the lot

or tract here described and property of said George Tom Stephens, a distance

of two hundred and two (202) feet to the property line of said residence lot

of W.A. Pool, and run thence Northerly along common property line between

the lot or tract described and said W.A. Pool residence lot, a distance of

one hundred seven (107) feet, to the beginning point; together with dwelling

house and all other improvements thereon.

ALSO:

That certain tract or parcel of land facing on Kirk Street in the City of

Roanoke, Alabama, and being a part of the former Douglas Hanson homeplace

and being bounded on the Westerly side of the former Douglas Hanson

homeplace and residence (now or formerly the property of Whit S. Lane

Estate) on the Northerly side of Kirk Street, on the Easterly side by now or

former property of Leon Phillips (former J.C. Wright homeplace) and on the

Southerly side by the former Ralph Benefield homeplace (now or formerly in

the possession of J.T. West); said property being more particularly

described as follows: Beginning at the South margin of Kirk Street and at

the NW corner of the above referred to Leon Phillips property and thence

running in a Southerly direction along the Westerly side of the property of

the said Leon Phillips a distance of 129 feet to the Northerly property line

of the former Benefield (now or formerly J.T. West) homeplace, thence in a

Westerly direction along the Northerly side of the former Benefield (now of

formerly J.T. West) property a distance of 82 feet to the Easterly side of a

brick wall, thence along the upper (Easterly) side of said brick wall in a

Northerly direction to the Southerly side of said Kirk Street (the same

being a distance of 129 feet); thence along the Southerly side of Kirk

Street in an Easterly direction a distance of 84 feet to the starting point;

together with all buildings, improvements and hereditaments situated

thereon.

Together with the hereditaments and appurtenances thereunto belonging and

all fixtures now attached to and used in connection with the premises herein

described.

Said sale will be subject to the right of way easements and

restrictions of record in the Probate Office of Randolph County, Alabama,

and will be subject to existing special assessments, if any, which might

adversely affect the title to subject property.

Said property will be sold on an “As Is, Where Is” basis without

warranty or recourse, express or implied as to title, use and/or enjoyment.

Said sale will be made for the purpose of paying the indebtedness

secured by the above described mortgage, and the proceeds thereof will be

applied as provided by the terms of said mortgage.
