NOTICE OF MORTGAGE FORECLOSURE SALE

Default having been made in the payment of the debt secured by that certain mortgage executed by Debra A. Bryan and James W. Bryan, Mortgagor(s) to Small Town Bank, Mortgagee, on May 14, 2007, said mortgage being recorded in the Probate Office of Randolph County, Alabama, on May 18, 2007, in Mortgage Book 515, Pages 369-373A by reason of such default, having declared all the indebtedness secured by said mortgage due and payable, and such default continuing, notice is hereby given that, acting under the power of sale contained in said mortgage, Small Town Bank, Mortgagee, will sell at public outcry, for cash, to the highest bidder, in front of the Courthouse door in the Town of Wedowee, Randolph County, Alabama, during the legal hours of sale at 12:00 p.m. on April 1, 2009, the following described real estate situated in Randolph County, Alabama, to-wit:

A parcel of land located in Section 36, Township 18 South, Range 12 East and Section 1, Township 19 South, Range 12 East, Huntsville Meridian, Randolph County, Alabama, being more particularly described as follows:

Commencing at an iron pin found marking the Northwest corner of the Northeast 1/4 of the Southeast 1/4 of said Section 36;

Thence North 87 degrees 38 minutes 30 seconds West for a distance of 993.17 feet to an iron pin set;

Thence South 46 degrees 36 minutes 03 seconds East for a distance of 1675.98 feet to an iron pin set;

Thence South 73 degrees 51 minutes 36 seconds West for a distance of 552.43 feet to an iron pin set;

Thence continuing South 73 degrees 51 minutes 36 seconds West for a distance of 485.36 feet to an iron pin set;

Thence South 63 degrees 35 minutes 38 seconds West for a distance of 53.49 feet to an iron pin set and the true point of beginning of the parcel to be herein described;

Thence South 46 degrees 36 minutes 03 seconds East for a distance of 1812.01 feet to an iron pin set;

Thence South 66 degrees 18 minutes 21 seconds West for a distance of 1128.34 feet to a point in the centerline of Copper’s Rock Creek;

Thence in a Northwesterly direction along the centerline of said creek for a distance of approximately 1968 feet to a point following these tie lines:

North 67 degrees 54 minutes 03 seconds West, 476.55 feet;

North 43 degrees 40 minutes 10 seconds West, 253.42 feet;

North 67 degrees 41 minutes 22 seconds West, 276.70 feet;

North 56 degrees 32 minutes 56 seconds West, 453.80 feet;

North 16 degrees 28 minutes 32 seconds West, 373.74 feet;

North 49 degrees 39 minutes 03 seconds West, 86.82 feet;

Thence leaving said creek North 63 degrees 35 minutes 38 seconds East for a distance of 1208.81 feet to an iron pin set;

Thence North 46 degrees 36 minutes 03 seconds West for a distance of 1442.97 feet to an iron pin set on the Easterly right of way of Randolph County Road 466 which has a 60 foot right of way;

Thence along said right of way North 24 degrees 53 minutes 29 seconds East for a distance of 54.65 feet to a point;

Thence continuing along said right of way North 28 degrees 15 minutes 26 seconds East for a distance of 8.47 feet to an iron pin set;

Thence leaving said right of way South 46 degrees 36 minutes 03 seconds East for a distance of 1484.60 feet to the Point of Beginning.

Together with the hereditaments and appurtenances thereto belonging, and also together with all buildings, structures, equipment, fixtures, and other improvements now existing, erected or installed thereon.

Said sale will be made subject to any restrictions of record in the Probate Office aforesaid, matters of survey, and to any Federal or State Tax liens, if any, and/or special assessments, if any, which might adversely affect the title to the premises.

Said sale will be made for the purpose of paying the indebtedness secured by the above-described mortgage to Small Town Bank, Mortgagee, and the proceeds thereof will be applied provided by the terms of said mortgage.
