MORTGAGE FORECLOSURE SALE

Default having been made in the payment of the indebtedness secured by that certain mortgage executed by Ronnie G. McAfee and Deborah J. McAfee, husband and wife, to Mortgage Electronic Registration Systems, Inc., solely as nominee for Wachovia Mortgage Corporation, on the 25th day of May, 2006, said mortgage being recorded in the Office of the Judge of Probate of Randolph County, Alabama, in Book 498, Page 303, the undersigned, Mortgage Electronic Registration Systems, Inc., as Mortgagee, under and by virtue of the power of sale contained in said mortgage, will sell at public outcry to the highest bidder for cash at the main entrance of the Randolph County Courthouse, Roanoke, Alabama, on the 27th day of May, 2008, during the legal hours of sale, the following described real estate, situated in Randolph County, Alabama:

PARCEL I:

Part of Lot #1 of Kimlar Subdivision as described and recorded in Plat Cabinet B, Slide 56, in the Probate Office of Randolph County, Alabama, beginning at the SW Corner of Lot #1 on the 795 contour line of Lake Wedowee; thence Northerly a distance of 220.0 feet along the West line of Lot #1; thence Easterly at an angle to the right of 90º 00′ 00″ a distance of 56.75 feet to the East line of Lot #1; thence Southerly along said line at an interior angle of 79º 47′ 14″ a distance of 118.84 feet; thence Southeasterly at an angle to the left of 22º 29′ 36″ a distance of 128.0 feet to the 795 contour line of Lake Wedowee; thence Westerly along said contour line a distance of 66.75 feet to the Point of Beginning.

Except all rights and easements owned by the Alabama Power Company lying below the 800 foot mean sea level elevation contour of the R. L. Harris Reservoir.

LESS AND EXCEPT a perpetual right of ingress and egress 15 feet in width from Rose Hill Public Road to the above described property. The existing roadway across Lot #1 of Kimlar Subdivision shall not interfere with the East septic system of said Lot #1 or the West septic system of said Lot #1 as established by the Randolph County Health Department. This right of ingress and egress shall run with the property to Grantees heirs, successors and assigns.

Parcel II:

Commencing at the accepted SE Corner of Section 33, Township 18 South, Range 10 East, Randolph County, Alabama; thence North 0º 16′ 50″ West along the East line of said Section a distance of 1527.57 feet to the Northerly right of way of Fosters Bridge Road; thence Southwesterly along said right of way a distance of 105.0 feet plus or minus to the 795 foot contour line of Lake Wedowee, said point being the Point of Beginning (no pin set); thence Northwesterly and Southeasterly along the 795 contour line a distance of 306.0 feet plus or minus to the Northerly right of way of Fosters Bridge Road; thence Northeasterly along said right of way a distance of 174.2 feet to the Point of Beginning.

Excepting all rights and easements owned by the Alabama Power Company lying below the 800 foot mean sea level elevation contour of the R. L. Harris Reservoir.

This sale is made for the purpose of paying the indebtedness secured by said mortgage, as well as the expenses of foreclosure.
