NOTICE OF
MORTGAGE FORECLOSURE SALE
ALABAMA, RANDOLPH COUNTY
Default having been made in the indebtedness secured by that certain mortgage executed by Stanley Arnett and Cynthia Arnett, husband and wife, J/T/R/S to Beneficial Alabama, Inc., dated February 17, 2006, said mortgage being recorded in Book 493, Page 160, in the Office of the Judge of Probate of Randolph County, Alabama. .
The undersigned, Beneficial Alabama, Inc., under and by virtue of the power of sale contained in said mortgage, will sell at public outcry to the highest bidder for cash before the courthouse door of Randolph County, Alabama, during the legal hours of sale, on November 15, 2007, the following real estate, situated in Randolph County, Alabama, to-wit:
One acre of land more or less lying in the NE 1/4 of the SE 1/4, Section 4, Township 22 South, Range 13 East in Randolph County, Alabama and being more particularly described as follows: Begin at a point where the North line of the NE 1/4 of the SE 1/4 of said Section 4, Township 22 South, Range 13 East intersects the West Right-of-Way line of the County Blacktop Road that runs from Bacon Level to Rock Mills and run South 08 degrees, 15 minutes East along the Westerly Right-of-Way Line to a point of intersection of the South line of the Lorenzo Bowan property for the point of beginning of the property herein to be described from the point of beginning run thence North 86 degrees, West along the South property line of Lorenzo Bowan (being also the North property line of Wallace B. Fetner and wife Bertha B. Fetner) a distance of 210 feet, run thence Southerly and parallel to the Bacon Level – Rock Mills Road a distance of 210 feet to a stake and corner; run thence South 86 degrees East a distance of 210 feet to a point on the West side of the Bacon Level-Rock Mills Road; run thence Northerly along the West side of said Road to an iron stake at the point of beginning
Said property is commonly known as 1930 County Road 75, Roanoke, AL 36274
The indebtedness secured by said Mortgage has been and is hereby declared due because of default under the terms of said Mortgage and Note, including but not limited to the nonpayment of the indebtedness as and when due. The indebtedness remaining in default, this sale will be made for the purpose of paying the same, all expenses of the sale, including attorney’s fees and all other payments provided for under the terms of the Mortgage and Note.
Said property will be sold subject to the following items which may affect the title to said property: all zoning ordinances; matters which would be disclosed by an accurate survey or by an inspection of the property; any outstanding taxes, including but not limited to ad valorem taxes, which constitute liens upon said property; special assessments; all outstanding bills for public utilities which constitute liens upon said property; all restrictive covenants, easements, rights-of-way; the statutory right of redemption pursuant to Alabama law; and any other matters of record superior to said Mortgage. To the best of the knowledge and belief of the undersigned, the party in possession of the property is Stanley Arnett and Cynthia Arnett or tenant(s).
