NOTICE OF MORTGAGE FORECLOSURE SALE
Default having been made under the terms of that certain Mortgage dated February 1, 2005 (the “Mortgage”), executed by Catherine M. Prestridge and James Craig Prestridge in favor of First Georgia Banking Company, recorded in MORT Book 476 Page 317, in the Office of the Judge of Probate of Randolph County, Alabama (the “Probate Court”), as modified by (i) that certain Modification of Mortgage dated July 13, 2005, recorded in MORT Book 485 Page 336 in the Probate Court, (ii) that certain Modification Agreement – Mortgage dated October 13, 2006, recorded in MORT Book 510 Page 27, in the Probate Court, (iii) that certain Modification Agreement – Mortgage dated August 29, 2008, recorded in MORT Book 538 Page 87, in the Probate Court, and (iv) that certain Modification Agreement – Mortgage dated August 29, 2008, recorded in MORT Book 538 Page 90, in the Probate Court, the undersigned, under and by virtue of the power of sale contained in the Mortgage and as authorized under Alabama law pursuant to section 35-10-1 et seq. of the Alabama Code, will sell at public outcry to the highest bidder for cash in front of the main entrance of the Randolph County Courthouse in Wedowee, Alabama, on May 18, 2010, during the legal hours of sale the following real estate situated in Randolph County, Alabama, to wit:
Commencing at the NW corner of the now or former Nickerson Hotel lot on the south side of paved sidewalk on East Main Street and running westerly along south side of said sidewalk a distance of 67 feet to cement wall at a line of property now or formerly in the possession of Dr. W. B. Ford, formerly S.S. Smith homeplace; thence in a southerly direction along the now or former Ford line a distance of 157 feet to a corner; thence easterly and along the north line of the now or former Sam Cohen property a distance of 75 feet to a corner on line of now or former Nickerson Hotel lot; thence in a northerly direction along the now or former Nickerson Hotel lot 153 feet to the point of beginning.
ALSO: One lot located on East Main Street in the City of Roanoke, Alabama, more particularly described as follows: Beginning on the south side of Main Street at the NE corner of the former lot of T. L. Belcher; run thence South 16 degrees West 3.16 chains to the SE corner of former Belcher lot; thence East 16 degrees East 3.16 chains to a pine post on the south side of East Main Street near a large white oak tree; thence West 15 degrees North 1.51 chains to the beginning corner, containing .47 of an acre, more or less.
This sale is made for the purpose of paying the indebtedness secured by the Mortgage, as well as the expenses of foreclosure.
This property will be sold on an “as is, where is” basis, subject to any easements, encumbrances and exceptions reflected in the records of the Office of the Judge of Probate of Randolph County, Alabama. This property will be sold without warranty or recourse, expressed or implied as to title, use and/or enjoyment and will be sold subject to the right of redemption of all parties entitled thereto.
The undersigned reserves the right to bid for and purchase the property and to credit its purchase price against the expenses of sale and the indebtedness secured by the property. This sale is subject to postponement or cancellation.
