Default having been made in the indebtedness secured by that certain mortgage executed by Nancy K. Perkins and husband, Ronald Gary Perkins, joint tenants to Mortgage Electronic Registration Systems, Inc acting solely as nominee for SunTrust Mortgage, Inc., its successors and assigns, dated April 17, 2007, said mortgage being recorded in Book 513, Page 720, in the Office of the Judge of Probate of Randolph County, Alabama. Said Mortgage was last sold, assigned and transferred to SunTrust Mortgage, Inc. The undersigned, SunTrust Mortgage, Inc., under and by virtue of the power of sale contained in said mortgage, will sell at public outcry to the highest bidder for cash before the courthouse door of Randolph County, Alabama, during the legal hours of sale, on February 3, 2011, the following real estate, situated in Randolph County, Alabama, to-wit: Lot #6 of Point View Estates Subdivision as described and recorded in Plat Cabinet B, Slide 198 on May 4, 2001, in the Probate Office of Randolph County, Alabama. Subject to that certain Boundary Line Agreement and Quitclaim Deed between Ronald Gary Perkins and wife, Nancy K. Perkins and Laddie Carter dated September 19, 2006, as recorded in Deed Book 325, pages 161-163, on September 21, 2006, in the Office of the Judge of Probate of Randolph County, Alabama. Subject to all rights and easements owned by the Alabama Power company lying below the 800 foot mean sea level elevation of the R.L. Harris Reservoir. Subject to a perpetual easement conveyed to Alabama Power Company by Curtis Hadley, et al as described and recorded in Deed Book 127, pages 33-35 in the Office of the Judge of Probate of Randolph County, Alabama. Subject to those certain Restrictive Covenants for Point View Estates Subdivision as recorded in Deed Book 314, page 12 in Office of Judge of Probate of Randolph County, Alabama. Lot #6 of Point View Estates Subdivision being further described as follows: 0.498 acres of land located in the SE 1/4 of the NE 1/4 of Section 17, Township 19 South, Range 11 East, Randolph County, Alabama, being more particularly described as follows: Commencing at the Southwest corner of the SW 1/4 of the NE 1/4 Section 17, Township 19 South, Range 11 East; thence North 88 degrees 40 minutes 23 seconds East a distance of 1378.88 feet to a point; thence North 1 degree 13 minutes 56 seconds West for a distance of 258.35 feet to a point; thence North 70 degrees 0 minutes 0 seconds East for a distance of 107.35 feet to a point; thence North 46 degrees 57 minutes 50 seconds East for a distance of 136.84 feet to a 1" pipe found; thence North 51 degrees 18 minutes 46 seconds East for a distance of 153.78 feet to a 1/2" rebar found on the 795 contour of R.L. Harris Reservoir; thence continuing along said 795 contour, North 40 degrees 44 minutes 23 seconds East for a distance of 22.78 feet to a 1/2" rebar set and the true point of beginning of the hereafter described tract of land; thence North 53 degrees 50 minutes 56 seconds West for a distance of 189.69 feet to a 1/2" rebar set; thence North 77 degrees 16 minutes 29 seconds West for a distance of 16.60 feet to a 1" rebar found on the southeastern right of way of an unnamed road (said road having a 40' radius); thence along said right of way an arc distance of 15.88 feet (said arc having a chord bearing of North 32degrees 50 minutes 22 seconds East for a distance of 15.77 feet) to a 1" pipe found; thence leaving said right of way South 87 degrees 36 minutes 18 seconds East for a distance of 60.84 feet to a 1" pipe found; thence North 81 degrees 19 minutes 9 seconds East for a distance of 242.55 feet to a 1" pipe found on the 795 contour of R.L. Harris Reservoir; thence along said 795 contour South 40 degrees 28 minutes 12 seconds West for a distance of 87.39 feet to a point; thence continuing along said 795 contour South 40 degrees 44 minutes 23 seconds West for a distance of 127.22 feet to a 1/2" rebar set and the true point of beginning. Said property is commonly known as LOT 6 County Road 2564, Wedowee, AL 36278 The indebtedness secured by said Mortgage has been and is hereby declared due because of default under the terms of said Mortgage and Note, including but not limited to the nonpayment of the indebtedness as and when due. The indebtedness remaining in default, this sale will be made for the purpose of paying the same, all expenses of the sale, including attorney's fees and all other payments provided for under the terms of the Mortgage and Note. Said property will be sold subject to the following items which may affect the title to said property: all zoning ordinances; matters which would be disclosed by an accurate survey or by an inspection of the property; any outstanding taxes, including but not limited to ad valorem taxes, which constitute liens upon said property; special assessments; all outstanding bills for public utilities which constitute liens upon said property; all restrictive covenants, easements, rights-of-way; the statutory right of redemption pursuant to Alabama law; and any other matters of record superior to said Mortgage. To the best of the knowledge and belief of the undersigned, the party in possession of the property is Ronald Gary Perkins and Nancy K. Perkins or tenant(s).
