MORTGAGE FORECLOSURE NOTICE

Default having been made in the terms of those mortgages executed by Will

Thackston and wife, June Thackston on or about January 12, 2009, to SmallTown Bank, which said mortgages are recorded in the Office of the Judge of Probate of Randolph County, Alabama, in Mortgage Volume 539, Pages 490-497 and Mortgage Volume 539, Pages 498-507; Mortgage Volume 470, Pages 172-180 executed on or about August 31, 2004, Mortgage Volume 460, Pages 689-696 executed on or about March 11, 2004, Mortgage Volume 447, Pages 111-115 executed on or about June 27, 2003, Mortgage Volume 430, Pages 631-635 executed on or about July 9, 2002, Mortgage Volume 434, Pages 122-126 executed on or about September 28, 2002, and Mortgage Volume 433, Pages 352-356 executed on or about July 9, 2002, and default continuing, and by virtue of the power of sale contained in said mortgages, the following described properties will be sold at public outcry, for cash, to the highest bidder, in front of the Courthouse door of said County, in Wedowee, Alabama, during the legal hours of sale, on the 4th day of February, 2011.

also being the true point of beginning of the parcel of land herein described;

mentioned right of way line 198.42 feet; thence in a southwesterly direction

along said right of way line being a curve concave northeasterly and having

a radius of 588.64 feet for 318.14 feet; thence N 86 degrees 19 minutes 30

seconds W 75.89 feet; thence leaving said right of way line N 03 degrees 05

minutes 08 seconds E 1698.33 feet; thence S 89 degrees 44 minutes 57

seconds E 545.66 feet to the westerly right of way line of said Randolph

County Road No. 123 (dirt) thence South 00 degrees 38 minutes 13 seconds

W along said right of way line 287.91 feet; thence continue along said right

of way line S 02 degrees 16 minutes 53 seconds W 370.49 feet; thence S

04 degrees 40 minutes 12 seconds W 381.87 feet; thence S 01 degree 02

minutes 27 seconds W 568.62 feet to the true point of beginning. Said

parcel of land lying in Section 18, Township 19 South, Range 11 East,

Randolph County, Alabama, and containing 21.570 acres.

survey recorded in Plat Book 3, Page 36, in the Office of the Judge of

Probate of Randolph County, Alabama.

Less and except all lands owned by Alabama Power Company below the

in Deed Book 151, Pages 253-257, as found in the Office of the Judge of

Probate of Randolph County, Alabama.

Subject to the Restrictive Covenants of Luther and Laska Rice as recorded

in Deed Book 131 at Pages 479-483 as found in the Office of the Judge of

Probate of Randolph County, Alabama.

Subject to the easements granted to Alabama Power Company by Luther

and Laska Rice found in Deed Book 117 at Pages 409-410, and 413-415, as

found in the Office of the Judge of Probate of Randolph County, Alabama.

Also, a right of way along the existing roadways to the public road.

Said sale is made for the purpose of paying the mortgage debts and costs of
