NOTICE OF MORTGAGE FORECLOSURE SALE

Default having been made in the payment of indebtedness secured by that certain mortgage executed by Perry Lee Copeland and his wife Angela Marie Copeland on the 7th day of February, 2003, to Bank of Wedowee which said mortgage is recorded in the Probate Office of Randolph County, Alabama, in Mortgage Book 440, at Page 72, and by reason of such default, having declared all of the indebtedness secured by said mortgage due and payable, and such default continuing, notice is hereby given that, acting under the power of sale contained in said mortgage, Bank of Wedowee will sell at public outcry, for cash, to the highest bidder, in front of the Courthouse door, Main Entrance in the City of Wedowee, Randolph County, Alabama, at 11:00 o'clock AM or otherwise during the legal hours of sale on January 25, 2011 the following described real estate situated in Randolph County, Alabama, to-wit:

Start at the NW corner of Section 13, Township 19 South, Range 12 East; then run South 86 degrees 01 minutes 20 seconds East 150.7 feet; then run South 36 degrees 01 minutes 20 seconds East 1189.30 feet; thence run South 05 degrees 16 minutes 07 seconds 725 feet to the point of beginning; then run South 05 degrees 16 minutes 07 seconds West 327.44 feet; then South 85 degrees 26 minutes 07 seconds West 757.70 feet to the center of County Road 103; then run North 23 degrees 50 minutes 03 seconds West 223.34 feet; then South 78 degrees 29 minutes 25 seconds West 980 feet, more or less, to the point of beginning, in accordance with the survey of J.R. Harrison, dated August 26, 1994 for Leon Mote, and containing five (5) acres, more or less, in Section 13, Township 19 South, Range 12 East, Randolph County, Alabama.

Start at the NW corner of the Section 13, Township 19 South, Range 12 East; thence run South 86 degrees 01 minutes 20 seconds East 150.70 feet; thence run South 86 degrees 01 minutes 20 seconds East 1189.30 feet; thence run South 05 degrees 16 minutes 07 second West 535.00 feet to the point of beginning; thence run South 05 degrees 16 minutes 07 seconds West 190,00 feet; thence run South 78 degrees 29 minutes 25 seconds West 980 feet, more or less, to the center of the paved county road; thence run North 23 degrees 50 minutes 03 seconds West 190 feet; thence run North 78 degrees 29 minutes 25 seconds East 989.80 feet to the point of beginning; in accordance with the survey of J.R. Harrison, dated August 26, 1994 for Leon Mote.

ALSO; N 1/2 of the NE 1/4 of the NW 1/4; and N 1/2 of the NW 1/4 of the NE 1/4 of Section 13, Township 19 South, Range 12 East, above being, 44 acres, more or less.

LESS AND EXCEPT ownership of Randolph County in the public road.

LESS AND EXCEPT: The N 1/2 of the NW 1/4 of the NE 1/4 of Section 13, Township 19 South, Range 12 East; containing 20 acres, more or less, lying and being in Randolph County, Alabama. Also conveyed is a right of ingress and egress along Perry Lee and Angela Copeland's other property, from the paved public roadway, to the above-described property,

LESS AND EXCEPT: A portion of that property described in the Office of the Judge of Probate of Randolph County, Alabama in Deed Book 231, Pages 74-76, and adjoining that property described in the Office of the Judge of Probate of Randolph County, Alabama in Deed Book 257, Pages 172- I 74, more particularly described as follows:

Begin at the NW corner of the N 1/2 of the NW 1/4 of the NE 1/4 of Section 13, Township 19 South, Range 12 East for the point of beginning; thence run West along the section line separating Sections 12 and 13 a distance of 100 feet; thence in a Southerly direction to a point; thence 192 feet East to a point which is the SW corner of the N 1/2 of the NW 1/4 of the NE 1/4 of Section 13, Township 19 South, Range 12 East; thence North along the Eastern line of the N 1/2 of the NW 1/4 or the NE 1/4 of Section 13 to the point of beginning.

Together with the hereditaments and appurtenances thereunto belonging and all fixtures now attached to and used in connection with the premises herein described.

Said sale will be subject to the prior mortgage in favor of Bank of Wedowee, the right of way easements and restrictions of record in the Probate Office of Randolph County, Alabama, and will be subject to existing special assessments, if any, which might adversely affect the title to subject property.

Said property will be sold on an "As Is, Where Is" basis without warranty or recourse, express or implied as to title, use and/or enjoyment.

Said sale will be made for the purpose of paying the indebtedness secured by the above-described mortgage, and the proceeds thereof will be applied as provided by the terms of said mortgage.

THIS IS AN ACTION TO COLLECT A DEBT. ANY INFORMATION OBTAINED WILL BE USED FOR THIS PURPOSE.
