Default having been made in the payment of the indebtedness secured by that certain mortgage dated February 17, 2006, executed by JENNY B. RUNIONS, unmarried, to PEOPLES INDEPENDENT BANK, which mortgage was recorded on February 23, 2006, in Mortgage Book 493, Page 76, of the mortgage records in the Office of the Judge of Probate of Randolph County, Alabama, which mortgage was, together with the indebtedness secured thereby, and the note evidencing the same, duly transferred to CHASE HOME FINANCE LLC, the undersigned has elected to declare the entire indebtedness secured by the said mortgage to be due and payable as provided in said mortgage, and notice is hereby given that pursuant to law and the power of sale contained in said mortgage, the undersigned will sell at public outcry, to the highest bidder for cash, in front of the main entrance to the Randolph County Courthouse at Wedowee, Alabama, during the legal hours of sale on the 1st day of February, 2011, the following described real estate, situated in Randolph County, Alabama, to-wit:

That certain tract or portion of land located in Section 36, Township 21 South, Range 12 East in Randolph County, Alabama, and more particularly described as follows: Lots 22 and 23 of the George Davis Subdivision, together with all improvements thereon, a map or plat of which is recorded in the Office of the Judge of Probate of Randolph County, Alabama, and which was prepared by W. Hoyt Vinson, a registered surveyor of the State of Alabama.

Also: That certain tract of land situated in Section 36, Township 21 South, Range 12 East in Randolph County, Alabama, and more particularly described as follows: Beginning at the SE corner of Lot 21 according to that certain map or plat of the George Davis Subdivision located in the SW quarter of the SE quarter in the SE quarter of the SW quarter of said Section, Township and Range, as recorded in the Office of the Judge of Probate of Randolph County, Alabama, at the point of beginning of the tract herein conveyed; from said point of beginning proceed due South to the intersection of said line with the Northern margin of a dirt road; thence turn in a Northwesterly direction and proceed along the Northerly margin of said dirt road to the point of intersection of said Northerly margin of said dirt road with the Southern boundary line of Lot 23 of said George Davis Subdivision; thence turn due East and proceed along the Southerly boundary line of Lots 23, 22 and 21 of the said George Davis Subdivision to the point of beginning of the tract herein conveyed. Said tract land being triangular in shape and located directly South of Lots 21, 22 and 23 of the George Davis Subdivision.

Less and Except: A tract of land adjoining Lot 21 of the George Davis Subdivision recorded in Plat Book 1, Page 76, in the Office of the Judge of Probate of Randolph County, Alabama, on the Southern boundary more particularly described as follows: Commencing at the SW corner of Lot 21 hereinabove described in the George E. Davis Subdivision, run thence North 88 degrees 45 minutes East 96 feet, more or less, to the SE corner of said Lot 21, run thence due South and in a continuation of a straight line coming down the East boundary of Lot 21 to the point of intersection of this line with the Northerly right of way of a paved road leading to Pine Valley Subdivision; run thence in a Northwesterly direction along the North right of way of said paved road to a point which is due South of the SW corner of said Lot 21 which may be determined by the continuance of a straight line running South from the West boundary line of Lot 21; run thence in a Northerly direction and in a straight line to the SW corner of said Lot 21.

Also less and except: The following tract of land located due South of Lot 21 of George Davis Subdivision which is more particularly described as follows: Commencing at the SE corner of Lot 21 as above-described as the point of beginning of the tract herein conveyed; run thence South 88 degrees 45 minutes West 96 feet, more or less, to a point; run thence due South to the intersection of this line with the North R.O.W. line of Cook Road; run thence in a Southeasterly direction along the North R.O.W. line of Cook Road to a point which is due South of the point of beginning of the tract herein conveyed; run thence due North to the point of beginning of the tract herein conveyed.
