NOTICE OF MORTGAGE FORECLOSURE SALE

RANDOLPH COUNTY, ALABAMA

Default having been made in regards to that certain Mortgage, executed by La’Keisha Sims on the 29th day of August, 2012, in favor of Habitat for Humanity, Troup County, Inc. recorded in Mortgage Book 576, Page 341 in the Probate Office of Randolph County, Alabama (“Mortgage”), Habitat for Humanity, Troup County, Inc., as Mortgagee, by reason of such default, having declared all of the indebtedness evidenced by the promissory note dated August 29, 2012, executed by La’Keisha Sims, as Debtor, and secured by said Mortgage due and payable, and such default continuing, notice is hereby given, that acting under the power of sale contained in said Mortgage, Habitat for Humanity, Troup County, Inc. for Humanity, as Mortgagee, will sell at public outcry, for cash to the highest bidder, in front of the Courthouse door, in Randolph County, Alabama, located at 1 South Main Street, Wedowee, AL 36278, on April 6, 2021 during the legal hours of sale, the following described real property situated in Randolph County, Alabama, to-wit:

Lot 3

A parcel of land located in Section 8, Township 20 South, Range 11 East, Huntsville Meridian, Randolph County, Alabama, being more particularly described as follows: Commencing at an iron pin found marking the Northwest Corner of the Northeast 1/4 of the Northeast 1/4 of said Section 8; thence South 02 degrees 12 minutes 54 seconds West for a distance of 913.74 feet to an iron pin set: thence North 70 degrees 17 minutes 18 seconds East for a distance of 294.88 feet to an iron pin set and the true Point of Beginning of the parcel to be herein described; thence continuing North 70 degrees 17 minutes 18 seconds East for a distance of 145.67 feet to an iron pin set; thence South 02 degrees 12 minutes 54 seconds West for a distance of 330.87 feet to an iron pin set on the North right of way of Randolph County Road 805 which has a 60 foot right of way; thence along said right of way South 79 degrees 15 minutes 19 seconds West for a distance of 17.24 feet to a point; thence continuing along said right of way South 73 degrees 04 minutes 59 seconds West for a distance of 45.21 feet to a point; thence continuing along said right of way South 69 degrees 26 minutes 15 seconds West for a distance of 82.02 feet to an iron pin set; thence leaving said right of way North 02 degrees 12 minutes 54 seconds East for a distance of 326.91 feet to the Point of Beginning. Together with and subject to all easements, covenants and restrictions of record. Said parcel contains 1.014 acres, more or less, according to that certain survey prepared by Richard L. Bisgard, AL PLS No. 23427 dated May 21, 2009.

Said property will be sold on an “as is, where is” basis, subject to all liens, encumbrances, unpaid real estate ad valorem taxes and governmental assessments and to all prior restrictions, rights-of-way, and easements appearing of record prior to the date of the Mortgage and those appearing after the date of the Mortgage and consented to by Habitat for Humanity, Troup County, Inc. This property will be sold without warranty or recourse, expressed or implied, as to title, use and/or enjoyment and will be sold subject to the right of redemption of all parties entitled thereto.

The Mortgagee reserves the right to bid for and purchase the real estate and to credit its purchase price against the expenses of sale and the indebtedness secured by the real estate. This sale is subject to postponement or cancellation.

Alabama law gives some persons who have an interest in property the right to redeem the property under certain circumstances. Programs may also exist that help persons avoid or delay the foreclosure process. This sale is made for the purpose of paying the indebtedness secured by said Mortgage, as well as the expenses of foreclosure.
