MORTGAGE FORECLOSURE NOTICE
Default having been made in the terms of that Mortgage executed on the 8th day of February, 2000 by Chad Whitmore and Dawn Whitmore, as Joint Debtors, to Small Town Bank, which said mortgage is recorded in the Office of the Judge of Probate, Randolph County, Alabama in Mortgage Book 398, at Page 291; and default continuing, and by virtue of the power of sale contained in said mortgage, the following described property will be sold at public outcry, for cash, to the highest bidder, in front of the Courthouse door of said County, in Wedowee, Alabama, at 11 o'clock a.m. on the 3rd day of May, 2019.
Parcel I- South ½ of the SW ¼ of the NW ¼, Township 19, Range 12, Section 2 containing 20 acres, more or less. Commencing at the SW corner of the SW ¼ of the NW ¼ running West to cemetery, thence northwest to road following said road to west line of SW ¼ of NW ¼ thence South to starting point, containing 14 acres, more or less, Section 3, Township 19, Range 12.
Parcel II- A portion of the SE ¼ of the NE ¼ described as follows: Beginning at the NW corner of Providence Church lot running East 230 feet to road; thence along said road to Karo
Daniel’s barn, thence NW to North line of SE ¼ of the NE ¼ making a distance of 1200 feet, thence along land line West 230 feet, thence South 1200 feet to starting point containing 6 ½ acres, more or less, all in Section 3, township 19, Range 12.
Parcel III- A tract of land in Section 3, Township 19, Range 12 in the Se ¼ of the NE ¼ in the NE corner being bounded on the west by a line starting at a point one foot west of the SW corner of the barn; this line extending approximately north to the north boundary line of this forty. This west line being intersected by a line 12 yards approximately south of the North line of this forty. This tract being bounded on the East for 110 yards by the acre tract now or formerly belonging to the late J.W. Smith Estate. This tract being bounded on the South by the road extending East from Providence Church being five acres, more or less.
Less and Except: Starting at the intersection of the dirt road on the eastern boundary line of the property described in paragraph 2 of deed recorded in Deed Book 135, Page 467, thence southward along said dirt road for 210 feet; thence eastern 210 feet; thence northerly 210 feet; thence to the point of beginning 210 feet and containing one acre, more or less.
Also Less and Except: Beginning at an iron pin on Providence Church Road approximately 100 feet west of the intersection of said Providence Church road and Sections 2 and 3 boundary line; then North to the boundary line of the SE ¼ of the NE 1/.4, Section 3, Township 19 South, Range 12 East approximately 480 feet thence west long said North quarter line for 300 feet; thence South to the Providence Church road approximately 480 feet; thence East to the point of beginning and containing 3.3 acres, more or less, and situated in the S/E ¼ of the NE ¼ of Section 3, Township 19 South, Range 12 East, Randolph County, Alabama.
Also Less and Except: Starting at the NE corner of the existing Providence Baptist Church property; thence Northwesterly 214 feet along said existing North property line to an iron pipe; thence northerly along the existing dirt road for 91 feet to an iron pipe; thence southeasterly for 197 feet, inches to an iron pipe; thence southerly 20 feet, 3 inches to the point of beginning, containing approximately .26 acres, and located in the SE ¼ of the NE ¼ of Section 3, Township 19 South, Range 12 East, Randolph County, Alabama.
Also Less and Except: A parcel of land containing one acre located in the SE ¼ of the NE ¼ of Section 3, Township 19, Range 12, Randolph County, Alabama; described as follows: Commence at a point on the westerly boundary of Cold Road at a point on the northerly boundary of Providence Church land; thence run North 25 degrees East with said road boundary 583 feet to the point of beginning of this description; thence continue on the same line 105 feet; thence 90 degrees left for a distance of 415 feet; thence 90 degrees left for a distance of 105 feet; thence 90 degrees left for a distance of 415 feet to the point of beginning.
Property will be sold “as is” with any and all liens or encumbrances of record. Said sale is made for the purpose of paying the mortgage debts and cost of foreclosure, and will be conducted by Chad Lee. Payment in full is due at the time of sale.
