MORTGAGE FORECLOSURE SALE

Default having been made in the payment of the indebtedness secured by that certain Mortgage executed by JEFFREY L WATERS, a married man, DANIEL SHANE YOUNG and BRITTNEY YOUNG, a married couple, and BETTY J WATERS, an unmarried woman, to METRO BANK on July 1, 2016, said Mortgage being recorded in the Office of the Judge of Probate, Randolph County, Alabama, in Book 613, Page 302, and METRO BANK, Mortgagee, by reason of such default having declared all of the indebtedness secured by said Mortgage due and payable and by virtue of the power of sale contained in said Mortgage will sell at public outcry for cash to the highest bidder, in front of the main entrance of the Randolph County Courthouse, Wedowee, Alabama, during the legal hours of sale on November 10, 2021, the following described real estate:

Parcel I: A parcel of land in the SW /14 of the SE1/4, Section 33; Township 18 South, Range 10 East containing 2.6 acres, more or less and being more particularly described as follows: Commencing from the Southeast corner of said Section 33 having state plane coordinates of North 1057703.79; East 573180.94; thence N 58°19’45” W 1745.26 feet to a point on the 795 mean sea level contour and the point of beginning; thence S 26°56’15” W 329.75 feet; thence S 13°13’20” W 81.27 feet; thence S 18°26’10” W 153.96 feet; thence S 5°56’05” W 110.84 feet and to the boundary of Randolph County Road 82; thence N 52°25’54” E 490.10 feet chord bearing and distance along the Northwest boundary of said road; thence N 32°22’15” E 141.91 feet; thence N 65°31’05” W 104.70 feet; thence N 20°26’05” E 85.64 feet; thence N 26°33’45” E 97.21 feet and to the 795 contour; thence South and West along the 795 contour; to the point of beginning. All bearings refer to the Alabama East Zone Grid. This property is subject to a perpetual easement between the 795 and 800 foot mean sea level contour by Alabama Power Company.

Less and Except: A perpetual easement by Ivey & Mavis Waters to Alabama Power Company described and recorded in Deed Book 129, Pages 916-918, on June 30, 1981, in the Judge of Probate Office of Randolph County, Alabama. A conveyance of property lying below the 795 foot datum place by Ivey & Mavis Waters to Alabama Power Company described and recorded in Deed Book 129, Pages 919-920, on June 30, 1981, in the Judge of Probate Office of Randolph County, Alabama.

All rights of easement owned by APC lying below the 800 foot mean sea level of the R.L. Harris Reservoir, Condemnation Proceedings of APC (Our Parcel is Tract 200-Parcel 48) in Deed Book 146, Pgs. 263-1027, on February 19, 1987.

Parcel II: Beginning at the Northeast corner of Lot 1 of Waters Estate Subdivision, as recorded in Cabinet A, Slide 641 in the Office of the Probate Judge of Randolph County, Alabama; thence S-1-55’36” E along the 795 contour line of Lake Wedowee a distance of 176.57 feet; thence S-86-58’45” E along said Lake a distance of 43.86 feet; thence S-29-58’03” E along said line a distance of 30.43 feet; thence N-1-26’59” W along said line a distance of 34.60 feet; thence N-64-22’06” E along said line a distance of 55.05 feet; thence N-31-46’32” E along said line a distance of 59.98 feet; thence N-28-39’13” E along said line a distance of 90.15 feet; thence N-43-30’13” E along said line a distance of 47.0 feet to an axle; thence S-25-59’27” W a distance of 116.0 feet; thence S-20-30’16” W a distance of 116.0 feet; thence S-64-38’57” E a distance of 112.13 feet; thence S-33-14’23” W a distance of 141.8 feet to the Northerly right-of-way of County Road 82; thence S-54-09’47” W along said right-of-way a distance of 336.37 feet; thence S-49-32’53” W along said right-of-way a distance of 170.79 feet; thence S-45-36’17” W along said right of way a distance of 109.31 feet to a 2 inch rebar on the Easterly right-of-way of Ivey Drive; thence the following call and distance along said right-of-way; Northerly along the Easterly right-of-way a distance of 188.0 feet plus or minus; said point being East 30.0 feet of Lot 7; N-7-48’30” W 121.95 feet; N-3-03’10” E, 87.12 feet; N-41-51’57” E 64.56 feet; N-32-23’52” E, 60.04 feet; N-88-38’57” E 76.67 feet; S-72-35’23” E, 68.2 feet to the end of said road; thence N-26-23’36” E a distance of 356.55 feet to the point of beginning containing 3.94 plus or minus acres, subject to all recorded easements.

Parcel III: The Northwest Quarter of the Northwest Quarter in Section 4, Township 19, Range 10, situated, lying and being in Randolph County, Alabama.

Lot 6A of Pointe South Subdivision Phase III as described and recorded on September 11, 1998, in Plat Cabinet B, Slide 26, in the Probate Judge Office of Randolph County, Alabama.

Lots 1,2,3,4 and 5 of Pointe South Subdivision Phase I as described and recorded in Plat Cabinet A, Slide 779, in the Probate Judge Office of Randolph County, Alabama.

The properties are located in Randolph County at 260 Point South Drive, Lineville, Alabama 36266 and County Road 82, Lineville, Alabama 36266.

This sale is made for the purpose of paying the indebtedness secured by the above described Mortgage, and the proceeds thereof will be applied as provided by the terms of said Mortgage.
