NOTICE OF MORTGAGE FORECLOSURE SALE

Default having been made under the terms of that certain mortgage executed by Cynthia S. Alsabrook, an unmarried woman, on the 13th day of April, 2017 to Bank of Wedowee, predecessor to First Bank of Alabama which said mortgage is recorded in the Probate Office of Randolph County, Alabama, in Mortgage Book 621, at Page 302, and by reason of such default, having declared all of the indebtedness secured by said mortgage due and payable, and such default continuing, notice is hereby given that, acting under the power of sale contained in said mortgage, First Bank of Alabama, Successor by merger to Bank of Wedowee will sell at public outcry, for cash, to the highest bidder, before the West entrance of the Courthouse in the City of Roanoke, Randolph County, Alabama, at 12:00 p.m. or otherwise during the legal hours of sale on August 18, 2020 the following described real estate situated in Randolph County, Alabama, to-wit:

That certain lot, parcel or tract of land, with wooden dwelling house theron, In the City of Roanoke Alabama, formerly commonly known as the Sue Pittman homeplace, fronting and abutting on the northeasterly margin of West Point Street; said lot of land being more particularly described as follows: Begin at a point on the northeasterly margin of West Point Street, which point is the common corner of the lot here described and a residence lot of the Enloes, now occupied by Mrs. Nan Enloe, and from such point run northeasterly alone the common property line between the lot here described and said Enloe lot, in a straight line, a distance of one hundred and eighty-six (186) feet, more or less, to a corner at the property line of land of J.S. Hunter heirs, run thence southeasterly along the common property line between the lot here described and said Hunter land a distance of ninety-one (91) feet, run thence southwesterly in a straight line, along common property lien between the lot here described and the residence lot of the within grantor named Eva White, a distance of one hundred and eighty-six (186) feet, more or less, to a point and corner on the northeasterly margin of said West Point Street, and run thence northwesterly along the northeasterly margin of West Point Street, a distance of ninety-one (91) feet, to the beginning point; also and together with, a right of way for ingress to and egress from said lot, parcel or tract of land, on, over and across a strip of land fronting nine (9) feet on said West Point Street and extending in uniform width of nine (9) feet, in a northeasterly direction, a distance of one hundred and fifteen (115) feet, said strip of land being part of the said residence lot of within grantor named Eva White and the vehicle drive-way thereinto, and said strip being contiguous or adjacent to the lot, parcel or tract of land herein described and conveyed; the purpose and intent being that such vehicle drive-way shall be for joint-use by owners of the lot, parcel or tract or land herein described and conveyed and the owners of said residence lot of the within grantor Eva White.

Together with the hereditaments and appurtenances thereunto belonging and all fixtures now attached to and used in connection with the premises herein described.

Said sale will be subject to the right of way easements and restrictions of record in the Probate Office of Randolph County, Alabama, and will be subject to existing special assessments, if any, which might adversely affect the title to subject property.

Said property will be sold on an “As Is, Where Is” basis without warranty or recourse, express or implied as to title, use and/or enjoyment.

Alabama law gives some persons who have an interest in property the right to redeem the property under certain circumstances. Programs may also exist that help persons avoid or delay the foreclosure process. An attorney should be consulted to help you understand these rights and programs as a part of the foreclosure process.

Said sale will be made for the purpose of paying the indebtedness secured by the above described mortgage, and the proceeds thereof will be applied as provided by the terms of said mortgage. The Mortgagee reserves the right to bid for and purchase the real estate and to credit its purchase price against the expenses of sale and the indebtedness secured by the real estate.

The failure of any high bidder to pay the purchase price and close this sale shall, at the option of Mortgagee, be cause for rejection of the bid, and if the bid is rejected, Mortgagee shall have the option of making the sale to the next highest bidder who is able, capable and willing to comply with the terms thereof.

This sale is subject to postponement or cancellation.

THIS IS AN ACTION TO COLLECT A DEBT. ANY INFORMATION OBTAINED WILL BE USED FOR THIS PURPOSE
