Default having been made in the terms of the Real Estate Mortgage executed on January 31, 2009, by Florence T. Sanders, Mortgager in favor of Terry Kennedy, Mortgagee and recorded in Mortgage Book 540 Pages 170 through 173 on February 4, 2009, in the Office of the Judge of Probate of Randolph County, Alabama. By reason of such default, having declared all indebtedness secured by said mortgage due and payable and such default continuing, The Law Firm of Kesa M. Johnston, LLC, as counsel for the Mortgagee under and by virtue of power of sale contained in said Mortgage will sell at public outcry, for cash, to the highest bidder, in front of the Courthouse door, West entrance at the Randolph County Courthouse in Wedowee, Alabama at 12:00 o’clock noon or otherwise during the legal hours of sale, on the 6th day of January, 2022, the following described real estate situated in Randolph County, Alabama, to wit:

Lot 11 of Lake George Subdivision Addition to Roanoke, Alabama, recorded in Plat Cabinet B, Slide 194 as found in the Office of the Judge of Probate of Randolph County, Alabama.

Also conveyed herein is the right of ingress and egress over and across existing private roadways from the public roadway to the above-described property. Subject to the Declaration of Protective Covenants and Restrictions of Lake George Subdivision recorded in Deed Book 289 at Pages 281 through 288 as found in the Office of the Judge of Probate of Randolph County, Alabama.

Subject to the easement conveyed to Alabama Power Company dated April 17, 2001, recorded June 15, 2001, in Deed Book 290 at Pages 265 and 266 in the Office of the Judge of Probate of Randolph County, Alabama.

Neither the Mortgagee, nor the officers, directors, attorneys, employees, agents or authorized representative of the Mortgagee make any representation or warranty, express or implied relating to the title or any physical, environmental, health or safety conditions existing in, or, at or relating to the property offered for sale. Any and all responsibilities or liabilities arising out of or in any way relating to any such condition, including those suggested by Code of Ala. (1975) § 35-4-271, expressly are disclaimed.
