NOTICE OF MORTGAGE FORECLOSURE
WHEREAS, default has been made in the terms of the Real Estate Mortgage, executed on the 19th day of May, 2008, by Lindsey N. Williams and Robert Anthony Jones, as Mortgagors, in favor of Charles W. Williams, Jr., as Mortgagee, as recorded in the Office of the Judge of Probate of Randolph County, Alabama, in Mortgage Book 532, Pages 407-409, and said default continuing, the Mortgagee, under the power of sale contained in said mortgage, will sell at auction for cash to the highest bidder on the steps of the Randolph County Courthouse in Wedowee, Alabama, at 11:00 a.m. on the 13th day of August, 2021, the following described real estate embraced in said Mortgage, situated in Randolph County, Alabama, to-wit:
A parcel of land located in Section 33, Township 20 South, Range 12 East, Randolph County, Alabama. Commencing at a rock found at the Southeast corner of Section 33, Township 20 South, Range 12 East, Randolph County, Alabama; thence North 01 degrees 53 minutes 07 seconds West for a distance of 260.00 feet to a point and the point of beginning of the parcel herein described; thence North 88 degrees 52 minutes 17 seconds West a distance of 967.23 feet to a point on the Easterly right of way of County Road 695; thence along said right of way North 19 degrees 41 minutes 24 seconds East a distance of 218.91 feet to a point; thence continuing along said right of way North 15 degrees 56 minutes 12 seconds East for a distance of 53.91 feet to a point; thence South 88 degrees 52 minutes 17 seconds East for a distance of 870.10 feet to a point; thence South 01 degrees 53 minutes 06 seconds East for a distance of 260.00 feet to a point and the point of beginning.
Also, a 2000 Redman Riverview mobile home, cream in color, with Identification No.: 14903417.
Subject to all easements, restrictions, judgments, reservations or other title defects, whether recorded or not. Said sale will also be made subject to any Federal Tax Liens and/or Special Assessments of any nature, if any, which might adversely affect the title to the property.
The property is being sold “as is, where is”. Said property is sold without warranty or recourse expressed or implied as to title, use or employment.
Said sale is made for the purpose of foreclosing of said mortgage, paying the mortgage debt, and the costs and expenses of foreclosure, including a reasonable attorney’s fee.
Mortgagee reserves the right to bid on the subject property. Said mortgage is a first mortgage and not junior to another mortgage of record. Said sale is also subject to unpaid taxes or assessments whether of record or not.
