Default having been made in the payment of the indebtedness secured by that certain mortgage executed on May 29, 2006, by Robert Jerry Birdsong, originally in favor of Cleveland Farms, Inc., and recorded in Mortgage Book 498 at Page 204 on May 30, 2006, in the Office of the Judge of Probate of Randolph County, Alabama. William A. Cleveland, as counsel for Mortgagee or Transferee and under and by virtue of power of sale contained in the said mortgage will, on September 19, 2023, sell at public outcry to the highest bidder at the main entrance of the Randolph County, Alabama, Courthouse in the City of Wedowee, during the legal hours of sale, the following real estate situated in Randolph County, Al., to wit: A lot or parcel of land in the SE ΒΌ of Section 2, Township 22, Range 10E, Randolph County, Alabama, more particularly described as follows: Commence at the West ROW margin of Cooledge St., also known as Co. Rd. 839, and the North ROW margin of the Transcontinental Gas Pipeline; this being the Point of Beginning. Thence in a South Westerly direction of approximately 257 degrees along North margin of TransCo ROW margin approximately 320 feet to an iron pin accepted as the NW corner of property owned by Thomas William McClain and recorded at Randolph Co., Al Probate Office on 2/24/05 in Deed Book 313 on Page 478. Thence along McLain property line South 7 degrees 15 minutes 9 seconds East 365.72 feet to an iron pin, thence; along McLain property line South 2 degrees 58 minutes 13 seconds East 175.66 feet to an iron pin, thence in an Easterly direction along McLain property line or north 86 degrees 33 minutes 27 seconds East 298.13 feet to an iron pin at the West margin of Cooledge St. ROW, thence approximately 550 along West ROW of Cooledge St. to Point of Beginning. Said described property being 4.1 acres more or less. This being the same property conveyed by Cleveland Farms, Inc., an Alabama Corporation to Robert Jerry Birdsong, in that certain Warranty Deed dated May 26, 2006 and recorded in the Office of the Judge of Probate of Randolph County, Al., in Deed Book 322, at Page 261.
