NOTICE OF MORTGAGE FORECLOSURE SALE

RANDOLPH COUNTY, ALABAMA

Default having been made in regards to that certain Mortgage executed by LATOYA DOZIER AND CORIE M. LEWIS on the 29th day of July, 2016, to HABITAT FOR HUMANITY, TROUP COUNTY, INC. (“Lender”) recorded in Mortgage Book 614, Page 483, in the Probate Office of Randolph County, Alabama (“Mortgage”), Lender, as Mortgagee, by reason of such default, having declared all of the indebtedness evidenced by the promissory note dated July 29, 2016, executed by LaToya Dozier and Corie M. Lewis, as Debtor, and secured by said Mortgage due and payable, and such default continuing, notice is hereby given, that acting under the power of sale contained in said Mortgage and pursuant to Alabama law, Lender, as Mortgagee, will sell at public outcry, for cash to the highest bidder, in front of the Courthouse door, in Randolph County, Alabama, located at 1 Main Street S, Wedowee, AL, Alabama 36278, on August 29, 2023 during the legal hours of sale, the following described real property situated in Randolph County, Alabama, to-wit:

A parcel of land located in Section 2, Township 22 South, Range 12 East, Huntsville Meridian City of Roanoke, Randolph, County, Alabama being more particularly described as follows: Commencing at an iron pin set at the intersection at the southwesterly right of way of West Point Street and the Southeasterly right of way of Guano Street; thence along the Southwesterly night of way of West Point Street South 35°03’57” East for a distance of 115.00 feet to an iron pin set and the true point of beginning of the parcel to be herein described: thence continuing along said right of way South 35°03’57” East for a distance of 75.44 feet to a point; thence continuing along said right of way south 36°20’33” East for a distance of 32.65 feet to a point; thence continuing along said right of way following a curve to the left having a radius of 1504.53 feet and an arc length of 54.98 feet, being subtended by a chord bearing south 40°16’53” East for a distance of 54.97 feet to an iron pin set; thence leaving said right of way south 47°14’34” West for a distance of 125.01 feet to an iron pin set; thence North 41°07’05” West for a distance of 111.95 feet to an iron pin set; thence North 27°29’50” West for a distance of 47.45 feet to an iron pin set; thence North 27°06’19” East for a distance of 99.33 feet to the point of beginning.

Together with and subject to all easements, covenants and restrictions of record. Said parcel contains 0.501 acres, more or less according to a survey prepared by Richard L. Bisgard, AL PLS No. 23427, dated October 1, 2008 and revised October 10, 2008.

Said property will be sold on an “as is, where is” basis, subject to all liens, encumbrances, unpaid real estate ad valorem taxes and governmental assessments and to all prior restrictions, rights-of-way, and easements appearing of record prior to the date of the Mortgage and those appearing after the date of the Mortgage and consented to by Lender. This property will be sold without warranty or recourse, expressed or implied, as to title, use and/or enjoyment and will be sold subject to the right of redemption of all parties entitled thereto.

The Mortgagee reserves the right to bid for and purchase the real estate and to credit its purchase price against the expenses of sale and the indebtedness secured by the real estate. This sale is subject to postponement or cancellation.

Alabama law gives some persons who have an interest in property the right to redeem the property under certain circumstances. Programs may also exist that help persons avoid or delay the foreclosure process. This sale is made for the purpose of paying the indebtedness secured by said Mortgage, as well as the expenses of foreclosure.
