Jean Marc Prescott v. Thomas R. Pancoast (or his heirs and devisees, if deceased); Diane Pancoast (or her heirs and devisees, if deceased); Fictitious Defendants A-Z, being those persons or entities occupying, possessing, or claiming any right whatsoever in that certain real property described herein; & that certain real property in Randolph County, Alabama, identified as parcel no. 56-07-02-04-0-000-001.002, Defendants.
TO ALL DEFENDANTS: You are hereby notified that on June 13, 2020, a Complaint was filed against you in the Circuit Court of Randolph County, Alabama, seeking an order granting possession and quiet title to 880 County Road 4801, Woodland, Alabama 36280. This property is described as follows: Lot #6 of Woodland Acres according to the Plat and Survey Map of Walter Pryor White, Alabama Registered Land Surveyor Number 12504, as recorded in the Office of the Judge of Probate of Randolph County, Alabama. Also: a road right-of-way jointly with others along the existing private roadways from the above described property to the public roadway. Less and Except: 5.04 acres, more or less, from Lot #6 of Woodland Acres, according to the Plat and Survey Map of Walter Pryor White, Alabama Registered Land Surveyor Number 2504, as recorded in the Office of Probate Judge of Randolph County, Alabama, more particularly described as follows: Beginning at the SE corner of Lot #6 thence S 89 degrees 44 minutes 18 seconds W a distance of 300 feet; thence N 37 degrees 25 minutes W a distance of 562 feet; thence 87 degrees 32 minutes 08 seconds E a distance of 700 feet; thence S 0 degrees 35 minutes 42 seconds E a distance of 254.81 feet; thence S 20 degrees 15 minutes 50 seconds E a distance of 177.53 feet to the point of beginning. This includes any and all improvements located thereon, including any houses, mobile homes, sheds, or barns. Plaintiff claims ownership by virtue of a Tax Deed from the Randolph County Revenue Commissioner.
An Order directing service by publication was entered on June 5, 2023, by the Randolph County Circuit Judge. All defendants and any person having any interest in said lands or improvements thereon, or any portion thereof, are hereby directed to plead, answer, demur, or otherwise respond to the Complaint within thirty days after the final publication of this notice, or suffer judgment by default to be rendered against them, it being intended that this notice shall be used to perfect service against all parties who cannot be personally served with a copy of the Complaint. Your answer must be filed with the Clerk of Court listed below and a copy served upon the Plaintiff. This notice complies with Ala. Code 6-6-564 to satisfy the requirements for an in rem quiet title judgment.
