Jean Marc Prescott, Plaintiff v. John R. Cole ( or his heirs and devisees, if deceased); Geraldine R. Cole (or her heirs and devisees, if deceased); Fictitious Defendants A-Z, being those persons or entities occupying, possessing, or claiming any right whatsoever in that certain real property described herein; & that certain real property in Randolph County, Alabama, identified as parcel no. 56-19-01-02-0-001-009.000, Defendants.
TO ALL DEFENDANTS: You are hereby notified that on June 13, 2020, a complaint was filed against you in the Circuit Court of Randolph County, Alabama, seeking an order granting possession and quiet title to 20374 Hwy. 77, Wadley, Alabama 36276. This property is described as follows: That certain tract or parcel of land on the northeasterly side of Alabama Highway 77, more particularly described as follows: Beginning for reference, at a point on the northeasterly margin of the right of way of said highway at a point 60 feet from the center line thereof, said point being marked by a concrete marker and designated Sta. 1030 x 06.3, Project S-625-B, and running thence along said northeasterly margin of said right of way North 55 degrees 14 minutes East 102.3 feet to the point of beginning; thence North 02 degrees 08 minutes West 77.1 feet; thence North 86 degrees 47 minutes East 247.7 feet; thence North 35 degrees 22 minutes West 214.0 feet; thence South 48 degrees 54 minutes West 296.0 feet to said Northeasterly right of way; thence South 55 degrees 14 minutes West along said northeasterly margin of the right of way 124.5 feet to the point of beginning of the property herein conveyed, said property lying and being in the SW 1/4 of the SW 1/4 of Section 2, and in the NW 1/4 of the NW 1/4 of Section 11, all in Township 22 South, Range 10 East, in Randolph County, Alabama, and containing 0.81 acres, more or less, together with all additions and improvements thereon. Plaintiff claims ownership by virtue of a Tax Deed from the Randolph County Revenue Commissioner.
An Order directing service by publication was entered on June 5, 2023, by the Randolph County Circuit Judge. All Defendants and any person having any interest in said lands or improvements thereon, or any portion thereof are hereby directed to plead, answer, demur, or otherwise respond to the Complaint within thirty days after the final publication of this notice, or suffer judgment by default to be rendered against them, it being intended that this notice shall be used to perfect service against all parties who cannot be personally served with a copy of the Complaint. Your answer must be filed with the Clerk of Court listed below and a copy served upon the Plaintiff. This notice complies with Ala. Code 6-6-564 to satisfy the requirements for an in rem quiet title judgment.
