Default having been made in the payment of the indebtedness secured by that certain mortgage executed by Flora R. Smith and Dennis A. Pruett, husband and wife, originally in favor of Mortgage Electronic Registration Systems, Inc., as nominee for GMAC Mortgage Corporation DBA a ditech.com, on December 22, 2004, said mortgage recorded in the Office of the Judge of Probate of Randolph County, Alabama, in MORT Book 475 Page 539; the undersigned Wells Fargo Bank, National Association, as Indenture Trustee for GMACM Home Equity Loan Trust 2004-HE5, as Mortgagee/Transferee, under and by virtue of the power of sale contained in said mortgage, will sell at public outcry to the highest bidder for cash, in front of the main entrance of the Courthouse at Wedowee, Randolph County, Alabama, on July 13, 2023, during the legal hours of sale, all of its rights, title, and interest in and to the following described real estate, situated in Randolph County, Alabama, to-wit: All that parcel of land in City of Wedowee, Randolph County, State of Alabama, as more fully described in Deed Book 309, Page 668 ID Number 92100, being known and designated as all land West of the Unnamed Road (County Road 33) in the South 1/4 of the Northeast 1/4 of the Northeast 1/4 of Section 35, Township 20 South, Range 11 East, Randolph County, Alabama being 9 acres, more or less.
