NOTICE OF PENDENCY OF COMPLAINT TO ESTABLISH TITLE TO REAL PROPERTY
TO: Any and all persons claiming or reputed to claim any title, interest in, lien or encumbrance to the lands described below.
NOTICE is hereby given that Savannah Leigh Brooks has filed a verified Complaint in the Circuit Court of Randolph County, Alabama by and through her next friend Cydney L. Dorsey against the above named Defendants and against any and all persons claiming any title to, interest in, lien or encumbrances upon the property described below for the purpose of establishing the title of said lands, to clear up all doubts and disputes concerning the same. All persons claiming any title, interest in, lien or encumbrance in said lands described below shall have thirty (30) days from the date of the last publication of this Notice to answer Complaint, or thereafter, a judgment by default may be entered against them. The property affected by this Notice is described in the Complaint and is described as follows:
Commencing at an iron pin found (capped “Fuller”) marking the NE corner of the NE 1/4 of the NW 1/4, Section 11; Township 22 South; Range 10 East, Randolph County, AL; thence S 08°57’47” W a distance of 1770.07 ft. to an iron pin found (open top pipe); thence S 27°44’51” W a distance of 90.10 ft. to an iron pin set in an existing ditch and the Point of Beginning of the hereafter described property; thence along the center of the ditch S 49°10’24” W a distance of 85.96 ft. to a point; thence continuing along the ditch S 35°16’05” W a distance of 64.67 ft. to an iron pin set on the Northeasterly ROW of Alabama State Highway #77 – aka Highland Ave. (120 ft. ROW); thence along said ROW N 61°13’58” W a distance of 74.59 ft. to an iron pin set; thence leaving the ROW N 45°46’59” E a distance of 150.00 ft. to an iron pin set; thence S 62°24’03” E a distance of 68.00 ft. to an iron pin set and the Point of Beginning, containing 0.22 ACRES, more or less.
And described in that certain Deed recorded in Deed Book 147, at Page 988 in the Office of the Judge of Probate of Randolph County, Alabama as follows:
Beginning 420 feet, more or less, south of formerly W. P. Kirk land, now or formerly Mrs. S. R. Edge’s land, at a ditch on the east side of State Highway #77 in the town of Wadley, Alabama, thence running in a northeasterly direction 150 feet, more or less, thence in a northwesterly direction 68 feet, more or less, thence in a westerly direction 150 feet, more or less, to State Highway No. 77; thence in a southeasterly direction 75 feet, more or less, along said highway to beginning point. Situated, lying and being in Section 11, Township 22, Range 10, Randolph County, Alabama.
