MORTGAGE FORECLOSURE SALE
Default having been made in the terms of the Real Estate Mortgage executed on May 9, 2019, by Troy Pope, Mortgagor in favor of Phillip Brothers Hardware, Inc., Mortgagee and recorded in Mortgage Book 643 Pages 727 through 729 on September 10, 2019, in the Office of the Judge of Probate of Randolph County, Alabama. By reason of such default, having declared all indebtedness secured by said mortgage due and payable and such default continuing, The Law Firm of Kesa M. Johnston, LLC, as counsel for the Mortgagee under and by virtue of power of sale contained in said Mortgage will sell at public outcry, for cash, to the highest bidder, in front of the Courthouse door, West entrance at the Randolph County Courthouse in Wedowee, Alabama at 12:00 o’clock noon or otherwise during the legal hours of sale, on the 14th day of July, 2022, the following described real estate situated in Randolph County, Alabama, to wit:
One business lot in the City of Roanoke described as follows: Beginning at the SW corner of building lot deeded to B. E. Satterwhite by R. W. Griffin and recently occupied by C. L. Huey as a Variety Store and running in a northerly direction along said lot a distance of 162 feet to White Street; thence in an Easterly direction along the South side of White Street a distance of 90 feet to a corner; said corner being the corner of former Annex of Griffin Hardware Company; thence South a distance of 52 feet to a corner, said corner being SE corner of former Annex, thence in a Westerly direction along an alley a distance of 58 feet to a corner, said corner being the wall of former Griffin Hardware Store; thence in a Southerly direction a distance of 100 feet to a corner on the North side of East Main Street; thence in a Westerly direction along the North side of East Main Street a distance of 40 feet to the point of beginning, together with all appurtenances thereto belonging.
This being the same property conveyed in Deed Book 410, Pages 92 through 94 as found in the Office of the Judge of Probate, Randolph County, Alabama.

This sale is made for the purpose of foreclosing said Mortgage, as well as the expenses of foreclosure, including reasonable attorneys fees. Mortgagee reserves the right to bid for and purchase the real estate and to credit its purchase against the expense of the sale and the indebtedness secured by the real estate.
Furthermore, the property to be offered pursuant to this notice of sale is being offered for sale, transfer and conveyance AS IS, WHERE IS. Neither the Mortgagee, nor the officers, directors, attorneys, employees, agents or authorized representative of the Mortgagee make any representation or warranty, express or implied relating to the title or any physical, environmental, health or safety conditions existing in, or, at or relating to the property offered for sale. Any and all responsibilities or liabilities arising out of or in any way relating to any such condition, including those suggested by Code of Ala. (1975) § 35-4-271, expressly are disclaimed. This sale is subject to all prior liens and encumbrances and unpaid taxes and assessments including any transfer tax associated with the foreclosure. The successful bidder must present certified funds in the amount of the winning bid at the time and place of sale. The Mortgagee reserves the right to award the bid to the next highest bidder should the highest bidder fail to tender the total amount due.
