Default having been made in the payment of the indebtedness secured by that certain Mortgage (as assumed, amended, and modified from time to time, the “Mortgage”) executed by CHRIS ROMBOKAS (“Mortgagor”) in favor of COLONIAL BANK, N.A. (the “Original Lender”) dated October 31, 2006 and recorded on December 7, 2006 in the Office of the Judge of Probate of Randolph County, Alabama (the “Recording Office”) in Mortgage Book 508, Page 30, as assigned to BRANCH BANKING AND TRUST COMPANY (“Mortgagee”) by that certain Assignment of Security Instruments and Other Loan Documents, dated August 14, 2009 and recorded in the Recording Office on November 4, 2009 in Mortgage Book 550, Page 440, as modified by that certain Mortgage Modification dated June 29, 2010, and recorded in the Recording Office on July 21, 2010 in Mortgage Book 556, Page 266, which default continues, TRUIST BANK, as successor by merger to Mortgagee and holder of the Mortgage (“Holder”), under and by virtue of the power of sale contained in the Mortgage and as provided under the laws of the State of Alabama applicable to the foreclosure of defaulted mortgages, will sell at public outcry to the highest bidder for cash at the main entrance of the Randolph County Courthouse in Wedowee, Alabama, on Monday, May 2, 2022, between the legal hours of sale the following real property situated in Randolph County, Alabama, to-wit:
Beginning at the point of intersection of the west section line of Section 22 and the east right-of-way of U.S. Highway 431; thence north along said west section line a distance of 475 feet to a point; thence northeasterly a distance of 448 feet to a point; thence southeasterly a distance of 108 feet to a point; thence S 14 degrees 30 minutes E a distance of 540 feet to a point; thence southwesterly a distance of 80 feet to the east right-of-way of U.S. Highway 431; thence northerly along the east right-of-way of U.S. Highway 431 to the point of beginning. Lying and being in Section 22, Township 21 South, Range 12 East, Randolph County, Alabama.
the “Land”.
And, in conjunction with the sale of the above-described Land, as provided under Ala. Code Section 7-9A-604 and the laws of the State of Alabama, Holder will also sell the following (together with the Land, collectively, the “Personal Property”): all fixtures: whether any of the foregoing is owned now or acquired later; all accessions, additions, replacements, and substitutions relating to any of the foregoing; all records of any kind relating to any of the foregoing; all proceeds relating to any of the foregoing (including insurance, general intangibles, and accounts proceeds). The goods that are or are to become fixtures on the real estate described in the Mortgage filed in Mortgage Book 508, Page 30.
The Personal Property described above will be sold on an “As Is, Where Is, With All Faults” basis and subject to unpaid ad valorem taxes and liens for unpaid future ad valorem taxes, and restrictive covenants, rights of way, easements and reservations recorded prior to the Mortgage that apply to the Property.
This sale is made for the purpose of paying the indebtedness secured by the Mortgage as well as the expenses of foreclosure.
The failure of any high bidder to pay the purchase price and close this sale shall, at the option of Holder, be cause for rejection of the bid, and if the bid is rejected, Holder shall have the option of making the sale to the next highest bidder who is able, capable, and willing to comply with the terms thereof.
