NOTICE OF FORECLOSURE

Default having been made in the payment of the indebtedness secured by that certain mortgage dated February 15, 2000, executed by Lorenzo J. Linson, a married man, to Chase Manhattan Mortgage Corporation, which mortgage was recorded on February 17, 2000, in Mortgage Record 399, Page 5, and modified by that certain Loan Modification Agreement recorded on July 31, 2019 in Book 642, Page 640; further modified by that certain Loan Modification Agreement recorded on March 24, 2020 in Mortgage Book 649, Page 188; further modified by that certain Extension Modification Agreement recorded on June 16, 2021 in Mortgage Book 667, Page 522 of the mortgage records in the Office of the Judge of Probate of Randolph County, Alabama, notice is hereby given that pursuant to law and the power of sale contained in said mortgage, the undersigned will sell at public outcry, to the highest bidder for cash, in front of the Main entrance to the Randolph County Courthouse at Wedowee, Alabama, during the legal hours of sale on April 12, 2022, the following described real estate, situated in Randolph County, Alabama, to-wit:

A portion of Lot 1 of the Calhoun Subdivision as recorded in Plat Book 1, Page 145, as found in the office of the Judge of Probate of Randolph County, Alabama, and being more particularly described as follows: Commencing at the Southwest corner of Lot 1 of said Calhoun Subdivision, said point being at the intersection of the Easterly R/W line of Doublehead Road with the Northerly R/W line of Shady Branch Drive; thence S 87 degrees 00 minutes 00 seconds E, along last mentioned R/W line, 144.83 feet to the true point of beginning of the parcel of land herein described; thence leaving said R/W line N 00 degree 54 minutes 30 seconds W, 149.46 feet; thence S 86 degrees 54 minutes 23 seconds E, 138.94 feet; thence S 03 degrees 15 minutes 26 seconds E, 149.77 feet to the Northerly R/W line of said Shady Branch Drive; thence N 87 degrees 00 minutes 00 seconds W, along said R/W line, 145.08 feet to the true point of beginning. Said parcel of land lying in Section 3, Township 22 South, Range 12 East, Roanoke, Randolph County, Alabama, and containing 0.485 acre, more or less, according to that certain survey prepared by Henry K. McBride, Ala. Reg. No. 12706 and dated February 14, 2000.

This sale is made for the purpose of paying the indebtedness secured by said mortgage as well as expenses of foreclosure. This property will be sold on an “as is, where is” basis, subject to any easements, encumbrances, and exceptions reflected in the mortgage and those contained in the records of the office of the Judge of Probate of the County where the above-described property is situated. This property will be sold without warranty or recourse, expressed or implied as to condition, title, use and/or enjoyment and will be sold subject to the right of redemption of all parties entitled thereto.

Alabama law gives some persons who have an interest in property the right to redeem the property under certain circumstances. Programs may also exist that help persons avoid or delay the foreclosure process. The successful bidder must tender a non-refundable deposit of Five Thousand Dollars ($5,000.00) in certified funds made payable to Stephens Millirons, P.C. at the time and place of sale. The balance of the purchase price must be paid in certified funds by noon on the second business day following the sale at the law firm of Stephens Millirons, P.C. at 120 Seven Cedars Drive, Huntsville, Alabama 35802. Stephens Millirons, P.C. reserves the right to award the bid to the next highest bidders should the highest bidder fail to timely tender the total amount due.
